User Obligations

To the maximum extent permitted by applicable law, metroproluxium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount paid by you to metroproluxium for the services in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless metroproluxium, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

For business disputes that cannot be resolved through direct communication, we prefer to use mediation or arbitration as alternative dispute resolution methods before pursuing litigation, where permitted by applicable law.

Termination

metroproluxium may terminate or suspend your access to our services immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion. Upon termination, your right to use our services will cease immediately.

Termination does not affect any rights or obligations that have accrued prior to termination. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Force Majeure

metroproluxium shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or government actions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and metroproluxium regarding our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
